Arbitrator Stephen Burbank ruled in favor of Drew Brees that his 2005 franchise tag by the Chargers applied as the first for calculating future franchise tag values. This means that if Brees is again tagged by the Saints next season, not only will he be paid around $23.5 million in 2013, but it will count as his 3rd and last franchise tag.
